Welcome to the Highly Affiliate Program! By joining our program, you agree to the following terms and conditions. Please read them carefully.

1. Program Overview

The Highly Affiliate Program allows approved affiliates to earn commissions by promoting our products/services through unique affiliate links.

2. Eligibility & Application

    •    You must be at least 21 years old to participate

    •    You must have an active website, blog, social media presence, or other platform to promote Highly

    •    We reserve the right to approve or reject any affiliate application at our sole discretion

    •    Multiple accounts per person/entity are prohibited

3. Commission Structure

3.1 Standard Commission

    •    Commission Rate: 20% of the sale value (excluding taxes, shipping, and refunds)

    •    Applies to all qualifying purchases made through your affiliate link
3.2 Newsletter Discount Code Exception

    •    When a customer uses the first-time customer 20% newsletter discount code, the affiliate commission changes to a flat $5 per qualifying purchase

    •    Qualifying Purchase: Minimum purchase amount of $[75] (before the discount is applied) is required to earn the $5 commission

    •    This flat commission applies regardless of order value when the newsletter discount code is used

3.3 General Terms

    •    Cookie Duration: 30 days from the initial click on your affiliate link

    •    Minimum Payout: $100 must be accumulated before payout is issued

    •    Payment Schedule: Payments are processed monthly via PayPal/bank transfer/or check

    •    Payment Timing: Payments are made within 10 days after the end of each payment period, following the refund period   

4. Affiliate Responsibilities

4.1 Promotion Guidelines

You agree to:

    •    Promote Highly honestly and accurately

    •    Clearly disclose your affiliate relationship in accordance with FTC guidelines (e.g., “#ad” or “affiliate link”)

    •    Not make false, misleading, or exaggerated claims about our products/services

    •    Not engage in spam, including unsolicited emails, comments, or messages

    •    Not bid on Highly’s brand name or trademarked terms in paid search campaigns

    •    Not use our brand name in domain names or social media handles that could cause confusion

4.2 Prohibited Activities

You may NOT:

    •    Use misleading or deceptive marketing practices

    •    Engage in cookie stuffing, fraud, or any manipulative tactics

    •    Create fake accounts or generate fraudulent transactions

    •    Promote through adult content, illegal activities, or content that promotes hate, violence, or discrimination

    •    Offer unauthorized discounts, coupons, or incentives using our name

    •    Misrepresent your relationship with Highly (e.g., claiming to be an employee or official partner)

5. Intellectual Property

    •    We grant you a limited, non-exclusive, revocable license to use our trademarks, logos, and marketing materials solely for promoting Highly through the affiliate program

    •    You may not alter our logos or materials without written permission

    •    All intellectual property rights remain with Highly

    •    This license terminates immediately upon your exit from the program

6. Commission Voidance & Adjustments

We reserve the right to void commissions and/or terminate your account for:

    •    Fraudulent activity or policy violations

    •    Returns, refunds, or chargebacks (commissions will be deducted)

    •    Cancelled orders

    •    Self-referral purchases (purchasing through your own link)

    •    Any activity deemed harmful to our brand

7. Tracking & Cookies

    •    Commissions are tracked through unique affiliate links and cookies

    •    Last-click attribution: The most recent affiliate link clicked before purchase receives the commission

    •    Technical issues may occasionally prevent proper tracking; we are not liable for lost commissions due to technical failures

8. Program Modifications

    •    We reserve the right to modify commission rates, program terms, or terminate the program at any time

    •    Changes will be communicated via email and/or the affiliate dashboard

    •    Continued participation after changes constitutes acceptance of new terms

9. Account Termination

We may terminate your affiliate account immediately if:

    •    You violate these terms and conditions

    •    You engage in fraudulent or unethical behavior

    •    Your account remains inactive for [6 months]

You may terminate your participation at any time by notifying us in writing. Upon termination:

    •    You must cease all use of our trademarks and marketing materials

    •    Unpaid commissions below the minimum threshold may be forfeited

    •    Commissions above the minimum will be paid according to the standard schedule

10. Tax Responsibility

    •    You are solely responsible for any taxes on your affiliate earnings

    •    U.S. affiliates earning over $600/year will receive a 1099 form

    •    International affiliates are responsible for complying with their local tax laws

11. Liability & Disclaimers

    •    The affiliate program is provided “as is” without warranties of any kind

    •    We are not liable for any indirect, incidental, or consequential damages arising from program participation

    •    We do not guarantee specific earnings or results

    •    You indemnify Highly against any claims arising from your promotional activities

12. Confidentiality

    •    Commission rates, performance data, and proprietary information are confidential

    •    You agree not to disclose this information publicly without written permission

13. Relationship

    •    You are an independent contractor, not an employee, partner, or agent of Highly

    •    This agreement does not create a joint venture or partnership

    •    You have no authority to bind Highly to any obligations

14. Governing Law

These terms are governed by the laws of  Oregon/USA. Any disputes will be resolved in the courts of Oregon.
